Thompson Hine trade attorney Dan Ujczo expects the only activity on trade in the first eight months of Joe Biden's presidency will be on issues either so small that they don't make a splash -- such as the Miscellaneous Tariff Bill and the Generalized System of Preferences benefits program -- or on issues that have an immediate need for action.
CBP CROSS Rulings
CBP issues binding advance rulings in connection with the importation of merchandise into the United States. They issue the rulings to give the trade community transparency of how CBP will treat a prospective import or carrier transaction. Common rulings include the tariff classification, country of origin, or free trade agreement applicability of merchandise, among other things. These rulings are available in CBP's Customs Rulings Online Search System (CROSS) database.
The U.S. has not publicly released all the companies that have applied for an extended period to get their North American-made vehicles into compliance with the tighter rules of origin, but both Canada and Mexico have published the list of 12 companies that have been approved. Since all three countries must approve alternative staging regimes, it follows that these companies' transition plans are cleared by the U.S., as well. The Federal Emergency Management Agency will continue export restrictions for an amended list of personal protective equipment, FEMA said in a temporary final rule released Dec. 30. The rule, which now also includes syringes and hypodermic needles that deliver vaccines, expands on two previous versions issued by FEMA this year (see 2008060061 and 2004080018) and renews the export restrictions -- which were scheduled to expire Dec. 31 -- through June 30, 2021.
The Census Bureau needs more time to assess the comments it received on whether to eliminate certain export filings for shipments to Puerto Rico and the U.S. Virgin Islands, partly because the comments were so split (see 2012040033), said Kiesha Downs, chief of Census’ Foreign Trade Division’s regulations branch. She also said the comments didn’t help the agency find alternative sources to collect the data that is normally submitted through the Electronic Export Information filings.

There is a desire for more “uniformity” for country of origin and marking under USMCA, similar to the rules in Part 102 of NAFTA, said Heidi Bray, manager-U.S. and global customs compliance for Fiat Chrysler Automobiles. Bray and other Commercial Customs Operations Advisory Committee members mentioned a variety of USMCA “challenges” during the Oct. 7 COAC meeting. She said she thinks it would be a good idea to bring back a USMCA working group to discuss those issues.
