BIS Adds 49 to Entity List for Sending Microelectronics to Russia
The Bureau of Industry and Security added 49 entities, mostly from China, to the Entity List for shipping microelectronics to Russian consignees connected to the country’s defense sector. The entities are semiconductor companies, technology businesses, logistics companies and others, and also include companies based in Estonia, Finland, Germany, India, Turkey, the United Arab Emirates and the U.K.

The entities are now subject to license requirements for all items subject to the Export Administration Regulations, and BIS will review licenses under a policy of denial. The additions took effect Oct. 6.
BIS said all the companies illegally shipped U.S.-origin integrated circuits to Russia, including those listed in Tier 1 of the Common High Priority Items List developed by the U.S. and its allies (see 2309260052). Those shipments, which occurred after March 1, include items classified under U.S. Harmonized Tariff Schedule subheadings 8542.31, 8542.32, 8542.33 and 8542.39, BIS said. The agency said Russia needs these microelectronics for “precision guidance systems in the missiles and drones” it uses against civilian targets in Ukraine.
Thea Kendler, assistant secretary for export administration at BIS, said these companies have accounted for a “significant portion” of global trade in U.S. integrated circuits to Russia from March through July. She said the Entity List additions are a “clear warning to others that we will not hesitate to act.”
BIS Undersecretary Alan Estevez said: “No matter how convoluted the trail may be or how many hands items are passing through, if U.S.-origin items are finding their way to Russia’s military, we will work tirelessly to stop it.”
The additions come days after BIS said exporters should require their customers to sign written compliance certifications if the shipment involves items that fall under one of nine high-priority Harmonized System codes and if the customer is in a country outside of the U.S.-led global export controls coalition (see 2310020023). Matthew Axelrod, the top BIS export enforcement official, said the agency needs “the help of industry -- we need you to exercise extra caution when shipping high-priority items to customers abroad, to help ensure those customers aren’t then funneling those items to Russian missile and drone programs.”
All exports that now require a license as a result of this rule that were aboard a carrier to a port as of Oct. 6 may proceed to their destinations under the previous eligibility as long as the items have been exported before Nov. 6, BIS said.
