Japanese Glycine Exporter, US Settle Claims on AD Case at Federal Circuit

Exporter Nagase & Co. and the U.S. settled all claims in Nagase's suit challenging the first administrative review of the antidumping duty order on glycine from Japan. As a result, the U.S. Court of Appeals for the Federal Circuit dismissed the exporter's appeal of the AD review (Nagase & Co. v. United States, Fed. Cir. # 25-1008).

The Court of International Trade previously sustained the Commerce Department's decision in the review to remove Nagase's compensation for payment expenses from the company's general and administrative expense ratio (see 2407300052). The court also said the exporter failed to exhaust its administrative remedies pertaining to its challenge to Commerce's assessment rate.

Counsel for Nagase didn't immediately respond to a request for comment.
