Census Adds AES License Codes to Reflect New BIS Chip Controls

The Census Bureau added five new license codes in the Automated Export System to reflect the Bureau of Industry and Security's recent export controls on advanced computing chips (see 2501130026), Census said in emails to industry this week.

AES filers should use New License Code 73 when exporting items under new BIS License Exceptions Artificial Intelligence Authorization (AIA), which authorizes certain U.S. exports of advanced chips to a group of 18 countries. Census said this code can be used with Export Control Classification Numbers 3A001.z, 3A090.a, 3A090.z, 3D001, 4A003.z, 4A004.z, 4A005.z, 4A090.a, 4A090.z, 4D001, 4D090, 4E001, 4E091, 5A002.z, 5A004.z, 5A992.z, 5D002.z, 5D992.z, 5E002 and 5E992.

License code 74 should be used for exports sent under License Exception Advanced Compute Manufacturing (ACM), which authorizes exports of 3A090, 4A090 and related .z commodities, software and technology to certain commercial or non-government end users located outside of Country Group D:5 nations or Macau “for the purposes of development, production, and storage of these chips,” Census said. This code can be used with ECCNs 3A001.z, 3A090, 3D001, 3E001, 4A003.z, 4A004.z, 4A005.z, 4A090, 4D001, 4D090, 4E001, 5A002.z, 5A004.z, 5A992.z, 5D002.z, 5D992.z, 5E002 and 5E992.

License code 75 should be used for License Exception Low Processing Performance (LPP), which authorizes and places caps on the number of advanced chips that can be shipped to nations outside of Country Group D:5 or Macau. This code can be used with ECCNs 3A001.z.1.a, z.2.a, z.3.a, z.4.a; 3A090.a; 4A003.z.1.a, z.2.a; 4A004.z.1; 4A005.z.1; 4A090.a; 5A004.z.1.a, z.2.a; and 5A992.z.1.

License code 76 should be used for certain shipments involving Universal Validated End Users and code 77 should be used for shipments involving National Validated End Users. If an entity meets BIS conditions to be a validated end-user, they can benefit from a single export authorization for exports to foreign data centers as opposed to applying for new licenses for each export.

For each of the new codes, filers can use all export information codes except “UG” and all modes of transport except “70” (fixed transport).
