Lawyer Barred From Practicing Before FMC for 1 Year After Misconduct Settlement
Marcus Nussbaum settled an attorney misconduct proceeding before the Federal Maritime Commission earlier this month, agreeing not to practice before the FMC for one year. If Nussbaum tries to practice before the commission before the one-year period or violates the settlement agreement, the FMC said it may "re-institute" the misconduct proceeding.

Nussbaum, a solo practitioner in New York, said in a Feb. 28 email that he didn't admit misconduct and that the settlement agreement "is not to be construed as a formal revocation and/or suspension proceeding." The FMC said "no formal findings of violation have been made."
The FMC opened the proceeding in January after accusing Nussbaum of misconduct in at least three proceedings. The commission said he allegedly falsified evidence; misrepresented certain facts, arguments and actions from the administrative law judge; misused confidential information from a former client; and acted "extremely uncivilly" (see 2401110062).
