Decision to Impose a Provisional Anti-Dumping Duty on Graphite Electrodes Originating in the People’s Republic of China

Today, the Cabinet has enacted a Cabinet Order relating to a provisional anti-dumping duty on graphite electrodes originating in the People’s Republic of China* (hereinafter referred to as “China”). The Cabinet Order will be made public on March 28, 2025, and the provisional anti-dumping duty shall be imposed on the goods originating in China during the period of March 29, 2025, to July 28, 2025.
1.Background
The Ministry of Economy, Trade and Industry (METI) and the Ministry of Finance (MOF) have been conducting an investigation since April 24, 2024, to determine whether or not to impose an anti-dumping duty on graphite electrodes originating in China.
As a result of the anti-dumping investigation, METI and MOF made a preliminary determination that inferred the fact of the importation of the dumped products and the fact of the material injury to domestic industry caused by such importation. (Notice of the Ministry of Finance [No. 52, February 28, 2025].)
On March 12, 2025, considering the facts found in the investigation, the Council on Customs, Tariff, Foreign Exchange and Other Transactions reported that it was appropriate to impose a provisional anti-dumping duty on graphite electrodes originating in China. (The rate of the provisional anti-dumping duty is 95.2%.)
2. Outline of the Cabinet Order
The objective of enacting this Cabinet Order is to impose a provisional anti-dumping duty on graphite electrodes originating in China. An investigation carried out upon receipt of an application requesting the imposition of an anti-dumping duty on such products has inferred the fact of the importation of the dumped products and the fact of the material injury, etc., to domestic industry caused by such importation, and as such, determined it is necessary to protect domestic industry.
3. Next Steps
The Cabinet Order will be made public on March 28, 2025, and the provisional anti-dumping duty shall be imposed on the goods originating in China during the period of March 29, 2025, to July 28, 2025.
