Used Car Export Rules Don't Apply for Stock Car Race in Mexico, CBP Says

U.S. racing teams shipping cars to Mexico for a stock car race later this month don’t have to comply with certain regulations governing exports of used self-propelled vehicles, CBP said in a recent ruling.

Those regulations, outlined in 19 CFR 192, don’t apply because the race cars won’t be entered into the “commerce” of Mexico and will be returned to the U.S. after the race, the agency said. “There is no indication that the purpose of transporting the vehicles out of the U.S. is to enter them into the commerce of Mexico,” CBP said.

CBP issued the decision in May after receiving a ruling request from Dell Will Customs Brokers about sending used racing cars to Mexico City in June for a NASCAR race. The broker said 180 race teams planned to move their cars and related equipment over the Mexico border using their own trucks. The cars are U.S.-owned but not titled “due to their status as off-road vehicles," CBP said.

The U.S. broker said they planned to submit filings in the Automated Export System, and a broker in Mexico will prepare entries for Mexico.
