The Consumer Product Safety Commission is issuing a direct final rule amending its safety standard for not-full-size baby cribs and play yards to incorporate the latest revisions to the ASTM voluntary industry standard, it said. The changes are effective Jan. 20, 2020, unless comments opposing the change are received by Nov. 22.

The Consumer Product Safety Commission will begin deploying its “two-way messaging” with CBP in ACE in late fall, its officials said at a recent Trade Support Network meeting, according to a blog post from CustomsNow. At that time, CPSC will begin using ACE to require examinations of cargo (instead of having to manually notify CBP officers) on more than 300 tariff codes for high-risk products that they will monitor in CBP’s electronic filing system. If CPSC marks a shipment under review, the filer should not begin immediately uploading documents to CBP’s document image system (DIS), the CPSC officials said, according to CustomsNow. Instead, CPSC will contact the filer and request the documents. CPSC has been working for years on its ACE integration, which will eventually allow CPSC and CBP to also share data on exam information and dispositions, a CPSC official recently said (see 1909240037).

The Consumer Product Safety Commission is proposing exemptions from testing requirements for children’s products containing certain unfinished manufactured fibers. Under the proposal, unfinished polyester (polyethylene terephthalate, PET), nylon, polyurethane (spandex), viscose rayon, natural rubber latex, acrylic and modacrylic would be exempt from testing requirements for certain elements listed in ASTM F963. All those elements besides polyester would also be exempt from testing for phthalates.

The Consumer Product Safety Commission is amending its regulations on durable infant and toddler products to clarify provisions related to mandatory consumer registration requirements for manufacturers. The agency’s final rule matches the definition of “durable infant or toddler product” to the full statutory definition; clarifies that the scope of each listed product category is defined in the applicable mandatory standard; clarifies listed product categories using the product name in the applicable mandatory standard; and clarifies the scope of the infant carriers and bassinets and cradles product categories, CPSC said. The changes take effect Oct. 24.
