DOE Delays Revised Filing Regulations for Natural Gas Imports, Exports

The Energy Department is delaying the effective date of a direct final rule that will amend the regulations for administrative procedures related to the import and export of natural gas (see 2505120045).

The changes were scheduled to take effect July 15, but the agency is extending that date to Aug. 13 after public commenters objected to its use of a direct final rule, saying the rule didn’t “satisfy the good cause exemption from notice and comment rulemaking under the Administrative Procedure Act.” The Energy Department disagreed, saying it gave “fair notice” of the changes in May. “Commenters cannot argue they were denied fair notice and an opportunity to comment solely based on how the notice was labeled.”

The agency decided to delay the rule, which will update and streamline the general requirements for filing documents with the Fossil Energy Office, by 30 days.
