Both Sides Agree to Briefing Schedule in 4.9 GHz Case
Both sides agreed to a briefing schedule in a case challenging the FCC’s order to give use of the 4.9 GHz band to the FirstNet Authority and, indirectly, AT&T (see 2410220027). The schedule was submitted last week to the U.S. Court of Appeals for the D.C. Circuit, which will hear the case (24-1363).

The Coalition for Emergency Response and Critical Infrastructure and other groups are challenging the order, while the Public Safety Spectrum Alliance is protesting aspects of it. In March, the D.C. Circuit declined to stay the order (see 2503190069). Under the proposed schedule, opening briefs would be due June 3 under the schedule, response briefs Aug. 4 and final briefs Sept. 17.
